Bivo Moto Pro Terms of Sale

Last updated: 2 November 2026

This English translation is provided for information only. The French version prevails.

Article 1. Purpose and scope

These general terms and conditions of sale (the “Terms of Sale”) govern the Bivo Moto Pro subscription offered by Guillaume Grandclement, sole proprietor (entrepreneur individuel, EI) trading as Bivo Moto, 47 rue Vivienne, 75002 Paris, France, registered with the Paris Trade and Companies Register as RCS Paris 131 714 172 (“Bivo Moto”).

Bivo Moto, available at bivomoto.com, lists accommodations that offer secure motorcycle parking, for people traveling by motorcycle (the “Travelers”). The Bivo Moto Pro subscription allows an accommodation establishment (the “Partner”) to be featured on Bivo Moto through a listing page (the “Listing”).

Bivo Moto Pro is reserved for business customers (professionnels), who subscribe for the purposes of their accommodation business. An establishment located in France must hold a SIRET number (French business registration number). An establishment located in another country certifies, by accepting the quote, that it carries on its business in accordance with the regulations of that country.

Use of the bivomoto.com website remains governed by its terms of use (the “Terms of Use”). For all matters relating to the subscription, these Terms of Sale prevail over the Terms of Use.

Article 2. Formation of the contract

Every subscription is subject to a quote issued by Bivo Moto based on the information provided by the Partner, including the type, capacity and parking of the establishment.

The contract is formed by acceptance of the quote within its validity period: by payment of the subscription, online or by bank transfer with the quote number as the payment reference, or by returning the quote signed and marked “Bon pour accord” (approved). The accepted quote and these Terms of Sale together form the contract. In the event of any conflict, the quote prevails.

By accepting the quote, the Partner acknowledges having read these Terms of Sale, attached to the quote, and accepts them. The applicable Terms of Sale are those in force on the date the quote is accepted. Bivo Moto may amend its Terms of Sale: the new version applies from the next renewal and is sent to the Partner with the reminder provided for in Article 3.3. A Partner who does not accept it may terminate under the conditions of Article 3.4. The Terms of Sale remain available at all times at bivomoto.com/cgv.

Article 3. Term, renewal and termination

3.1 Term. The subscription runs for 12 months from the date the Listing goes live. For an establishment already listed on Bivo Moto before 1 January 2027, the first period runs from 1 January to 31 December 2027.

3.2 Renewal. At the end of its term, the subscription renews for a new 12-month period, with no commitment beyond that period, depending on the payment method chosen by the Partner:

  • with a payment method that renews automatically (card or SEPA Direct Debit), the subscription renews automatically (tacit renewal), and the price for the following period is charged on the anniversary date;
  • with payment by bank transfer, Bivo Moto sends the Partner a renewal quote 30 days before the anniversary date. Paying it no later than 15 days after the anniversary date renews the subscription without interruption. Otherwise, the subscription ends on the anniversary date and the Listing is removed.

3.3 Reminder. Bivo Moto informs the Partner by email, 75 days before the anniversary date, of the end date of its subscription, the price for the following period, where applicable the new version of the Terms of Sale, and how to terminate or, for payment by bank transfer, how to renew.

3.4 Termination by the Partner. The Partner may terminate its subscription simply by email to resiliation@bivomoto.com, no later than 30 days before the anniversary date. Termination takes effect at the end of the current period. Amounts paid for the current period are not refunded. Bivo Moto acknowledges receipt by email. For payment by bank transfer, the Partner simply does not pay the renewal quote (Article 3.2).

3.5 Non-renewal by Bivo Moto. Bivo Moto may decide not to renew a subscription, by notifying the Partner by email no later than 30 days before the anniversary date. Cases of suspension and removal during the subscription are set out in Article 9.

Article 4. Price and payment

4.1 Price. The subscription price is stated in the quote. It depends on the type and capacity of the establishment, according to Bivo Moto's price list in force.

4.2 Founder rate. The founder rate applies to any quote accepted no later than 28 February 2027: a 20% discount on the first year of subscription, under the conditions set out in the quote. A quote is accepted by payment or by returning it signed (Article 2); its validity period does not extend that date. An establishment listed free of charge on Bivo Moto in 2026 receives the same discount if it requests it within the period Bivo Moto specifies. At the end of this first year, the rate in force at renewal applies, announced under the conditions of Article 4.3.

4.3 Price changes. Bivo Moto may change its prices at each renewal. The price for the following period is communicated with the reminder provided for in Article 3.3: any new price is thus announced to the Partner before its termination deadline. A Partner who does not accept it may terminate under the conditions of Article 3.4.

4.4 VAT. Bivo Moto benefits from the French VAT exemption for small businesses (franchise en base de TVA): “TVA non applicable, art. 293 B du CGI” (VAT not applicable, Article 293 B of the French General Tax Code), then, from 1 January 2027, “TVA non applicable, art. L. 233-3 du CIBS” (VAT not applicable, Article L. 233-3 of the French Code of Taxes on Goods and Services). If Bivo Moto becomes liable for VAT, VAT will be added to the prices invoiced from that date, at the applicable rate.

4.5 Payment. The subscription is payable in advance, upon acceptance of the quote and then at each renewal, at the Partner's choice:

  • by card or SEPA Direct Debit, with automatic renewal: the renewal is charged on the anniversary date;
  • by bank transfer, with the quote number as the payment reference; the subscription is then renewed by paying a renewal quote (Article 3.2).

Bivo Moto sends the paid invoice upon receipt of payment. Work on the Listing begins upon receipt of payment. No discount is granted for early payment.

4.6 Late payment. If the payment of an automatic renewal fails, for example because a card has expired or a direct debit is rejected, Bivo Moto informs the Partner. Any late payment automatically incurs late payment penalties at three times the French statutory interest rate, plus a fixed compensation of €40 for recovery costs. Paying a renewal quote by bank transfer within the period set out in Article 3.2 is not late payment. If payment has still not been made 15 days after a reminder, Bivo Moto may suspend the Listing until payment is received.

Article 5. Partner's obligations

Parking levels. The Partner declares its establishment's parking as one of the following three levels; the declared level is stated in the quote and on the Listing:

  • Locked garage (Garage fermé): a covered building or room, fully enclosed and locked at night, where the motorcycles are parked: a garage, lock-up garage or barn.
  • Enclosed parking (Parking fermé): a yard or parking area surrounded by walls or a fence, with access closed at night by a gate. A simple barrier arm is not sufficient.
  • Private parking (Parking privé): an on-site parking area made available to guests and not intended for public use. It may be uncovered and unfenced.

Bivo Moto checks the facilities based on photos. Night-time closure is a matter of the Partner's declaration and undertaking.

The Partner undertakes to:

  • provide accurate and up-to-date information about its establishment: parking, rates, contact details, photos, texts;
  • maintain the declared parking for the entire term of the subscription, and notify Bivo Moto without delay of any change in parking, any closure and any sale of the establishment;
  • welcome Travelers in accordance with its Listing and honor the Bonus Bivo it offers;
  • comply with the regulations applicable to its accommodation business.

The Partner grants Bivo Moto the rights of use set out in the quote over its texts, photos and information. The Partner warrants that it holds the necessary rights to this content.

The Partner remains solely responsible for its relationship with Travelers: booking, stay, payment and follow-up on their requests.

Article 6. Bonus Bivo

6.1 Principle. The Bonus Bivo is an optional perk that the Partner chooses to offer to Travelers who come through Bivo Moto. It is described on the Listing and indicated by the “Bonus Bivo dispo” badge in search results.

6.2 Conditions. The Bonus Bivo must be a genuine perk, reserved for Travelers who come through Bivo Moto. It may not repeat a perk already offered to all guests of the establishment, nor consist of a late check-out. Bivo Moto may refuse a bonus that does not meet these conditions.

6.3 How Travelers receive it. Travelers only need to mention Bivo Moto when booking, in a message, during a call or upon arrival. The Partner may not require any other proof.

6.4 Booking channel. The Bonus Bivo applies regardless of the booking channel, unless its description on the Listing limits it to bookings made directly with the establishment.

6.5 Changes. The Partner may change or withdraw its Bonus Bivo at any time through an update request (Article 8.4).

6.6 Refused bonus. If a Traveler reports that a Bonus Bivo was refused, Bivo Moto contacts the Partner and reminds it of these rules. In the event of a further confirmed refusal, Bivo Moto removes the Bonus Bivo and the badge from the Listing. The subscription continues.

Article 7. Bivo Moto's commitments

7.1 Services. Bivo Moto provides the services described in the quote: creation and publication of the Listing, announcement when it goes live, direct connection between the Partner and Travelers with no commission, monthly report and updates.

7.2 Obligation of means (obligation de moyens). Bivo Moto uses reasonable efforts to ensure the visibility of the Listing to Travelers. Bivo Moto does not guarantee any volume of visits, contacts or bookings, nor any particular position in search results or on the map. The ranking of results follows the criteria described in the Terms of Use.

7.3 Website availability. Bivo Moto endeavors to ensure continuous access to bivomoto.com. The website may be interrupted for maintenance or in the event of a technical incident; such occasional interruptions do not give rise to any compensation.

7.4 Website presentation. Bivo Moto remains free to decide the editorial presentation of its website: layout, display order, features. Such changes do not alter the nature of the services provided for in the quote.

Article 8. Publication, review and updates

8.1 Content. After payment, Bivo Moto informs the Partner of the content needed for the Listing, distinguishing between required and optional content. Bivo Moto writes the Listing in its own editorial style and may refuse content that is misleading or unlawful.

8.2 Publication. Bivo Moto publishes the Listing within 10 business days of receiving all required content. If this content is not provided within 30 days of payment, Bivo Moto publishes the Listing with the information available to it, including information from the establishment's website, and the subscription starts on the date the Listing is published.

8.3 Review. Once the Listing is live, the Partner reviews it and informs Bivo Moto of any corrections to be made. These corrections are made free of charge.

8.4 Updates. During the subscription, the Partner may request an update of its Listing: rates, photos, texts, contact details, Bonus Bivo. Bivo Moto makes the update within 5 business days. Updates are included in the subscription, within the limits of reasonable use. In the event of clearly excessive requests, Bivo Moto informs the Partner and may suggest grouping them.

Article 9. Suspension and removal of a Listing

9.1 Parking not matching the subscription. The consequences of parking that does not match the parking declared in the quote are set out in the quote.

9.2 Establishment no longer meeting the conditions. If, during the subscription, the establishment loses its secure parking or closes, Bivo Moto suspends the Listing and gives the Partner 30 days to remedy the situation. If the situation is not remedied within this period, the Listing is removed and the contract ends, without refund.

9.3 Sale of the establishment. In the event of a sale, the buyer may take over the subscription until the end of its term, simply upon request; Bivo Moto then updates the Listing. If the subscription is not taken over, the Listing is removed and the contract ends, without refund.

9.4 Serious breach. In the event of a serious breach by the Partner, including without limitation providing false information, serious and verified complaints from Travelers, or harm to Bivo Moto's reputation, Bivo Moto sends the Partner a written warning. Where the breach can be remedied, the Partner has 15 days to do so. If it cannot be remedied, or if it is not remedied within this period, Bivo Moto removes the Listing and the contract ends, without refund.

9.5 Non-payment of a renewal. For a payment method that renews automatically, suspension for late payment is provided for in Article 4.6. For payment by bank transfer, failure to pay the renewal quote ends the subscription (Article 3.2).

Article 10. Liability and force majeure

10.1 Relations with Travelers. Bivo Moto is not a party to the relationship between the Partner and Travelers. Bivo Moto is not liable for bookings, stays, payments, disputes between them, or any harm suffered by Travelers, or damage to their motorcycles or belongings, during the stay.

10.2 Partner information. The Partner is solely responsible for the information it provides and for the compliance of its establishment.

10.3 Limitation. Bivo Moto's liability is limited to direct damages proven by the Partner, up to the amount paid for the current subscription period, except in the event of gross negligence or willful misconduct.

10.4 Force majeure. Neither party is liable for a failure to perform caused by force majeure, within the meaning of Article 1218 of the French Civil Code, for example a major outage at the website's hosting provider. The affected obligations are suspended for the duration of the impediment.

Article 11. Discontinuation or transfer of Bivo Moto

11.1 Discontinuation of business. If Bivo Moto ceases its business, Listings remain online until the end of the current subscriptions, which are not renewed.

11.2 Transfer. In the event of a transfer of the Bivo Moto business, current contracts are transferred to the acquirer, who assumes the obligations under them. The Partner hereby consents to this transfer and will be notified of it by email.

Article 12. Personal data

12.1 Partner data. Bivo Moto processes the Partner's contact and billing data to perform the contract, invoice the Partner and inform it about Bivo Moto's services. This data is kept for the duration of the contractual relationship, then for the periods required by law, including 10 years for invoices. It is shared only with the necessary technical service providers: website hosting, email delivery, payment and invoicing.

12.2 Traveler requests. Contact requests sent by Travelers from the Listing are forwarded to the Partner. The Partner handles them under its own responsibility and solely to respond to them.

12.3 Rights. The Partner may exercise its rights of access, rectification, erasure and objection by writing to contact@bivomoto.com. The Partner may also file a complaint with the CNIL (French data protection authority).

Article 13. Governing law and disputes

The contract is governed by French law. In the event of a disagreement, the parties first seek an amicable solution, in writing, for 30 days. Failing agreement, if both parties entered into the contract as merchants (commerçants), the dispute is brought before the competent courts within the jurisdiction of Paris; in all other cases, it is brought before the court having jurisdiction under the ordinary rules.

These Terms of Sale are drafted in French. An English translation is provided for information purposes. In the event of any discrepancy between the two versions, the French version prevails.
